Terms and Conditions

• Platform: the website and associated services provided by SKAI Gen-Tech, including the interface for creating, training, and managing AI assistants.
• User: any natural or legal person using the Platform.
• AI Assistant: a virtual assistant created and managed by the User through the Platform.
• Subscription: a paid plan for using the Platform, billed monthly or annually.
• OpenAI API Key: a User-provided personal key required for the AI assistants to operate.
• Knowledge Base: data uploaded or entered by the User to train the assistant.
• Malicious Actions: actions that violate internet ethics or applicable laws.

• To use the services, a user account must be created.
• Users are responsible for providing accurate information and ensuring account security.
• SKAI Gen-Tech reserves the right to terminate accounts in case of violations or abuse.

• The Platform enables the creation of AI assistants via iframe, script, or URL.
• Users can customize prompts, colors, welcome messages, and more.
• Users can upload knowledge base data such as text, files, Q&A, or scrape their websites.
• Demo functionality and trial periods are planned.

• Services are provided through paid plans, with payments processed via Stripe.
• Subscriptions renew automatically unless canceled before the renewal date.
• Additional features may incur extra fees.
• Fee changes will be announced at least 30 days in advance.
• No refunds for unused or partially used services.

• Each User must acquire and provide their own OpenAI API key.
• API keys are securely stored and used only within the Platform.

• Users are fully responsible for uploaded content, AI assistant behavior, and legal compliance.
• AI assistants are not substitutes for professional advice.
• SKAI Gen-Tech is not liable for any AI-generated content or its consequences.

• The Platform and its software are the property of SKAI Gen-Tech.
• Users retain ownership of their trained AI assistants.
• SKAI Gen-Tech may use anonymized data to improve the service.

• The Platform complies with GDPR and the Bulgarian PDPA.
• Strict technical and organizational measures protect user data.

• Users must comply with all applicable laws and OpenAI usage policies.
• Unlawful, fraudulent, or harmful activities are strictly prohibited.
• Users must respect third-party intellectual property rights.
• Users must not perform malicious actions as defined in these Terms of Use.
• Users must not extract data or build derivative databases from the Platform’s content.
• Users must not impersonate others or mislead SKAI Gen-Tech or third parties.
• Users must report any violations or suspicious behavior immediately.
• Users must not use viruses, bots, worms, or any code that interferes with the platform’s operation or security.

• The Platform is provided “as is” and “as available.”
• SKAI Gen-Tech does not guarantee uninterrupted, timely, secure, or error-free operation.
• No guarantees that defects will be corrected or that the Platform is virus-free.
• SKAI Gen-Tech is not liable for:
  • Use of the services.
  • Technical or operational failures.
  • Downloaded content.
  • User-generated content.
  • User or client behavior, whether online or offline.
• SKAI Gen-Tech is not responsible for access issues caused by factors outside its control (e.g. software, hardware, internet, or force majeure).
• Users are responsible for the cost and maintenance of their own equipment or internet access required to use the Platform.
• SKAI Gen-Tech may intervene in platform operations or suspend access if reasonably justified.
• To the fullest extent permitted by law, SKAI Gen-Tech shall not be liable for indirect, consequential, incidental, or punitive damages, including loss of profit.
• In any case, liability is limited to a penalty of BGN 100.

• Disputes shall first be resolved through negotiation in good faith.
• If resolution is not reached, the competent court in Bulgaria shall have jurisdiction.
• For international private disputes, private international law rules apply.

SKAI Gen-Tech shall not be liable for service disruptions caused by unforeseeable and uncontrollable external events.

• Both parties agree to maintain the confidentiality of any business, technical, or other sensitive information exchanged through the Platform.

• Users agree to indemnify and hold harmless SKAI Gen-Tech against claims, damages, or expenses arising from misuse or violation of these Terms or third-party rights.

• SKAI Gen-Tech may update these Terms with prior notice.
• Continued use of the Platform after changes implies acceptance.

• Users may terminate their accounts at any time.
• SKAI Gen-Tech may suspend or terminate accounts in case of violations or misuse.

• The Platform may integrate with third-party services, which are subject to their own terms and conditions.
• SKAI Gen-Tech is not responsible for failures caused by such third-party services.

• High availability of the Platform is a priority but is not guaranteed.
• Users will be informed in advance about planned maintenance.
